‍This Privacy Policy explains how I collect, use and protect personal information through Infectious Audio and its Infectious Memories service.

1. Who I am and how to contact me

‍Infectious Audio is operated by Gareth Morris as a sole trader, based in Birr, Co. Offaly, Ireland. I am the data controller for personal information collected through this website and through my services. ‍

2. Information I may collect

Depending on how you interact with me, I may collect:

  • your name and contact details

  • information contained in emails, telephone calls or enquiries

  • project or event information you provide

  • wedding or christening dates, venues and related planning information

  • the name of a child in connection with a christening booking, provided to me by the parent(s) or guardian(s) making the booking

  • booking, contract, invoice and payment information

  • correspondence relating to a project or booking

  • voice recordings created as part of Infectious Memories, which may include recordings of children in the circumstances described in Section 5.1

  • Remote Voices recordings and contributor contact details

  • recordings and related material submitted to me for Audio Restoration

  • technical website information collected through Squarespace and, where you consent to analytics cookies, through Google Analytics — including pages viewed, general location derived from your approximate location, device and browser type, and how you arrived at the site

‍I only aim to collect information that is reasonably necessary for the relevant enquiry, service or business purpose.

3. Enquiries and potential bookings

When you contact me about a project, wedding, christening or other service, I use the information you provide to: ‍

  • respond to your enquiry

  • discuss your requirements

  • provide information or quotations

  • check availability

  • prepare for a possible booking or project

‍The lawful basis for this processing will normally be taking steps at your request before entering into a contract, or my legitimate interest in responding to genuine business enquiries.

4. Clients and booked projects

If you book Infectious Audio or Infectious Memories, I may use your personal information to:

  • manage the booking or project

  • communicate with you

  • plan and deliver the agreed service

  • issue invoices and maintain financial records

  • provide completed work

  • deal with reasonable follow-up questions or support

Where this information is necessary to provide the service you have booked, the lawful basis is normally performance of our contract.

‍Some financial and business records must also be retained to meet legal and tax obligations.

5. Infectious Memories recordings

Infectious Memories involves recording voice messages from participating guests, family members or other contributors.

‍These recordings may contain identifiable voices, names, personal stories, memories or other information voluntarily included by the speaker.

‍Recordings are used for the purpose of creating the private audio keepsake requested by the client.

‍Participation in the recording experience is voluntary. My legitimate interest in processing these recordings is to provide the private keepsake service requested by the client while respecting the reasonable privacy expectations of contributors.

‍I do not use guest recordings publicly for advertising, demonstrations, social media or other promotional purposes without appropriate permission.     

5.1 Recordings involving children

The recording experience may include age-appropriate prompts intended for children, and a christening keepsake is, by its nature, centred on a child. ‍

I am always present in the vicinity of the recording station while it is in use. Children take part within the setting of a family event and under the responsibility of a parent, guardian or other responsible adult attending with them. I give contributors appropriate space and privacy to record their message, but I do not operate an unattended recording station or deliberately arrange private one-to-one recording sessions with children.

I do not use any recording involving a child publicly, including for demonstrations, advertising, social media or portfolio purposes, without the express permission of a parent or legal guardian. ‍

Where a christening keepsake is booked directly by a parent or legal guardian, any information about the child that is needed to produce the keepsake is processed on their instruction as my client.

A christening keepsake may also be arranged as a gift by a grandparent, godparent or other family member. Where this would involve recording the child or otherwise processing personal information about the child beyond what is reasonably necessary to arrange the booking, I will obtain the approval of a parent or legal guardian before doing so.

A parent or legal guardian may contact me using the details in Section 1 if they have questions or wish to exercise applicable data-protection rights in relation to their child's information.

6. Remote Voices

Remote Voices allows someone who cannot attend an event in person to contribute a recording remotely.

If a client gives me another person's contact details so I can arrange a Remote Voices contribution, I will use those details only as reasonably necessary to contact that person and manage their contribution.

A Remote Voices contributor may provide:

  • their name

  • contact details

  • their relationship to the recipient or event

  • an audio recording

  • correspondence relating to the recording

That information is used for the purpose of arranging, preparing and including their contribution in the relevant Infectious Memories project.

7. Audio Restoration recordings

Audio Restoration involves cleaning, restoring or digitising material you send or bring to me — including cassettes, VHS tapes, phone voicemails, CDs, DVDs and existing digital files.

I use this material solely to carry out the restoration or digitising work you have requested. I do not use it for any other purpose — including marketing, portfolio use, demonstrations or social media — under any circumstances, and I do not require separate permission requests for this because the commitment is absolute rather than conditional.

Material submitted for restoration often contains the voices of other people besides the person who gave it to me — for example, other family members recorded decades earlier, or other callers captured on a saved voicemail. I have no practical way to seek consent from those individuals directly, often because the recording is old, because I have no means of identifying or contacting them, or both. I process this material on the basis of my legitimate interest, and the legitimate interest of the person who has instructed me, in completing the specific restoration service requested, strictly limited to that purpose. This material is never used or disclosed beyond delivering the finished work to the person who commissioned it.

Original physical media (tapes, discs) is returned to you once the work is complete, as described on the Audio Restoration page.

8. Cookies

This website uses cookies. Essential cookies needed to run the site are used automatically. Analytics cookies are used only with your consent, given through the cookie banner shown when you visit the site.

9. Who may process your information

I do not sell personal information.

Where reasonably necessary, personal information may be processed by service providers I use to operate the business, including:

  • Squarespace, for website hosting, site functionality and analytics

  • Google Workspace, for business email and communication

  • Google, for website analytics, where you have consented to analytics cookies

  • banking, accounting or professional service providers where necessary for business administration

  • technical, storage or delivery providers where required to complete or deliver a particular project

I aim to share only the information necessary for the relevant service.

10. International data transfers

Some technology providers I use may process information outside the European Economic Area.

Where personal information is transferred internationally, I rely on the safeguards made available by the relevant service provider and applicable data-protection law, which may include adequacy decisions, the EU-US Data Privacy Framework or Standard Contractual Clauses.

This includes Google, in connection with Google Analytics, which participates in the EU-US Data Privacy Framework.

11. How long I keep information

I do not keep personal data indefinitely unless there is a legitimate reason to do so.

As a general approach:

  • unsuccessful or general enquiries may normally be retained for up to 24 months after the last meaningful contact

  • client correspondence and project records may be retained for as long as reasonably necessary to manage the working relationship and any follow-up matters

  • financial, invoice and tax records may be retained for at least the period required by Irish law

  • Remote Voices contact details will not normally be kept longer than reasonably necessary to manage the relevant project

  • working audio files, raw recordings and project session files are normally kept for 12 months after delivery (or 15 months where a project may include an Anniversary Edition), primarily to allow for revisions, re-delivery, or the anniversary re-edit where applicable, and are then permanently deleted

  • final delivered keepsake files are normally kept for up to 24 months after delivery as a courtesy backup for re-delivery, and are then permanently deleted

  • Audio Restoration originals and working files are handled as agreed with each client at the time of the project, and are not retained beyond what is needed to complete and back up that specific job

  • material I have been given specific permission to use for promotional purposes may be retained until that permission is withdrawn or the material is no longer required

  • Google Analytics user-level and event-level data is currently set to a retention period of 12 months. Standard aggregated reporting may remain available beyond that period in accordance with Google Analytics' own retention system.

Irish Revenue currently requires businesses to retain relevant original business records for six years.

Specific retention arrangements for project audio may also be agreed directly with the client.

12. Security

I take reasonable steps to protect personal information and project material from unauthorised access, loss, misuse or disclosure.

No online or electronic storage system can be guaranteed to be completely secure, but I aim to use reputable services and sensible access controls appropriate to the nature of the information being handled.

13. Your data-protection rights

Depending on the circumstances, you may have rights including:

  • access to your personal data

  • correction of inaccurate information

  • deletion of personal data

  • restriction of processing

  • objection to certain processing

  • data portability

  • withdrawal of consent where processing is based on consent

Where a request relates to a child's information, it can be made by that child's parent or legal guardian on their behalf.

These rights are subject to the conditions and exceptions provided by applicable data-protection law.

14. Complaints

If you have concerns about how I handle your personal information, I would encourage you to contact me first so I can try to resolve the issue.

You also have the right to lodge a complaint with the Data Protection Commission in Ireland.

15. Changes to this policy

I may update this Privacy Policy when my services, technology or data-processing practices change.

The latest version will always be published on this website with an updated revision date.
